Welcome to xswiftfund (the "Platform"). These Terms & Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and CAPITALE FINANCE, a French SARL with a capital of 100,000 EUR, registered under SIREN 791 261 639 (RCS Paris), having its registered office at 10 Rue de Saint-Sénoch, 75017 Paris, France (operating xswiftfund), concerning your access to and use of our website.

By accessing the Platform, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Platform and must discontinue use immediately.

To apply for financing through the Platform, you must satisfy the following minimum conditions:

• You must be at least 18 years of age (or the legal age of majority in your jurisdiction).
• For personal funding, you must be a private individual with valid government-issued identification.
• For business funding, you must be an authorized officer, entrepreneur, or owner of a legally registered SME or startup.
• You must provide an active, monitored email address and a valid phone number.

xswiftfund operates exclusively as a non-login, non-portal intake platform. You will not create a user account, and you will not have access to an online client dashboard.

All subsequent operations, including document requests, identity verifications (KYC/AML), underwriting evaluations, approval negotiations, and disbursement authorizations, are managed **manually via direct email communication**.

You are responsible for ensuring the security of your own email client and providing accurate data during form intake.

xswiftfund acts as a digital intake processing platform. Submission of an application form does **not** constitute an offer of credit, a binding contract, or an approval decision.

All funding decisions are subject to detailed manual underwriting, strict compliance validations, anti-fraud checks, and regulatory guidelines applicable in your local jurisdiction. We reserve the right to decline any application at our sole discretion.

All fees, including administrative costs, processing margins, and optional insurance premiums, will be calculated and disclosed transparently before final disbursement.

No fees are collected upfront. Administrative fees are settled upon approved disbursement. Any payment requests, fee structures, or changes in terms will be sent in writing via verified corporate email and must be confirmed by you before execution.

We reserve the right to terminate or suspend your access to the Platform, or discontinue the review of your active application, without notice or liability, for any reason, including breach of these Terms, submission of falsified details, or fraudulent activities.

You agree to defend, indemnify, and hold xswiftfund and our corporate affiliates harmless from and against any loss, damage, liability, or claim arising out of your use of the Platform or violation of these Terms.
